02. HOW WE USE YOUR INFORMATION

The information we collect is used solely to provide and improve our electrical, telephone, and low-voltage data cabling services, including:

  • Internal Coordination: Scheduling updates, dispatching technicians, and providing internal document links or device schematics to our team.
  • Customer Communication: Sending project updates, invoice notifications, scheduling confirmations, and site-specific media (such as walkthrough videos).
  • Technical Support: Delivering manuals or spreadsheets requested by customers or site managers.

03. SMS/MOBILE MESSAGING COMPLIANCE

Independent Wiring Inc. uses SMS/MMS to communicate with employees and designated customer contacts.

  • Opt-In: By providing your mobile number to us verbally on-site, over the phone, via written agreement, initiating a text conversation with our staff, or by requesting a quote using our website form and clicking the check-boxes, you consent to receive service-related text messages from Independent Wiring Inc.
  • Types of Messages: Messages may include scheduling alerts, links to project documents, site photos/videos, and billing notifications.
  • Opt-Out: You can cancel the SMS service at any time. Just text STOP to the number sending the messages. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or reply UNSTOP.
  • Help: For more information or assistance, reply HELP to any message or contact our IT department at IT@independentwiring.com.
  • Frequency: Message frequency varies based on your project’s status, activity, and specific requests for information; fewer than 10 per month. Message and data rates may apply.

04. THIRD-PARTY SHARING AND DISCLOSURE

Independent Wiring Inc. does not sell, rent, or lease its customer lists or PII to third parties. SMS/Mobile Consent Non-Disclosure: Specifically, your mobile information and SMS consent will not be shared, sold, or traded with third parties or affiliates for marketing or promotional purposes. We only share information with subcontractors or service providers (such as our phone system provider, Dialpad) as necessary to perform the specific business services requested by you.

5. PERMITTED SHARING

We may share your personal information with the following categories of third parties for the purposes described below (excluding SMS opt-in data and mobile numbers):

  • Service Providers: We engage trusted third-party service providers to perform functions and provide services to us. By engaging our services or opting into our mobile messaging program, you agree to be bound by these Terms. SMS consent is handled exclusively through the voluntary methods listed in Section 02.

To facilitate these services, we use various communication methods, including verbal, email, and SMS/MMS mobile messaging to coordinate with employees, customers, site managers, and client account representatives.

02. Mobile Messaging Program Terms

SMS opt-in is a separate, voluntary action and not a mandatory condition of simply “engaging services.” By providing your phone number and opting in to receive messages, you agree to the following:

  • Purpose of Messaging: Messages may be sent by Managers and the Technician(s) assigned to your project, to provide scheduling updates, links to internal or account-relevant documents (e.g., invoices, spreadsheets), device schematics, technical manuals, project media (photos/videos of task progress or technical/logistical issues encountered on-site) and other information required for us to transact our business with you.
  • Opt-In: You may opt-in to our messaging program by providing your mobile number to us verbally on-site, over the phone, via written agreement, initiating a text conversation with our staff, or by requesting a quote using our website form and clicking the check-boxes.
  • Message Frequency: Message frequency varies based on your project’s status, activity, and specific requests for information; fewer than 10 per month. Message and data rates may apply.
  • Message and Data Rates: Standard message and data rates may apply from your wireless carrier. Independent Wiring Inc. is not responsible for any costs incurred by you for receiving or sending messages.
  • Help: For assistance, reply HELP to any of our messages or email IT@independentwiring.com.
  • Opt-Out: You can cancel the SMS service at any time. Just text STOP to the number sending the messages. 03. Carrier Liability

Mobile carriers (including, but not limited to, T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages. We provide these communications as a convenience to facilitate project management, but delivery is subject to the effective transmission of your wireless provider.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties of any kind, whether express, implied, or statutory, regarding the Service. To the fullest extent permitted by law, we expressly disclaim all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Disclaimer of Liability for Service Interruption

We are not liable for any delays, interruptions, or failures of the Service caused by factors beyond our reasonable control, including but not limited to, natural disasters, acts of government or military, acts of public enemies, war, riots, strikes, power outages, network outages of third-party providers, or equipment failures. We will make reasonable efforts to restore the Service as soon as practicable.

Third-Party Services and Content Disclaimer

The Service may allow you to access or use services, content, or websites provided by third parties. We are not responsible for the content, privacy policies, or practices of any third-party services or websites. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods, or services.

04. Prohibited Content

Independent Wiring Inc. and its employees will not engage in sending illegal, misleading, or deceptive content. This includes, but is not limited to, content related to hate speech, fraud, or illicit goods. You agree not to send any content to our Staff that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

05. Intellectual Property

All technical manuals, schematics, and project media (photos/videos) shared by Independent Wiring Inc. are the property of the Company or its respective clients/suppliers and are provided for the sole purpose of completing the specific contracted task. Unauthorized distribution of these materials is prohibited.

06. Compliance with Industry Standards

You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations. You further agree that your use of the Service, and any content or data you provide, shall at all times comply with the generally accepted practices and standards of the Construction industry, including but not limited to OSHA regulations and NEC guidelines10

We warrant that the Service will be provided in a professional and workmanlike manner, in accordance with the standards of care and skill generally observed by reputable providers of similar services. Our commitment to these standards is in addition to, and not a replacement for, any specific legal or regulatory obligations that we must meet.

You acknowledge that our compliance with these standards is conditional on your adherence to the acceptable use policies and other terms set forth in this Agreement. We reserve the right to audit your usage and, in the event of any non-compliance, to suspend or terminate your access to the Service.

07. Limitation of Liability

To the maximum extent permitted by law, Independent Wiring Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our communication services.

08. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

09. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to our website. Your continued use of our services or receipt of messages following such changes constitutes your acceptance of the new Terms.
